The recognition of the plurality of families in Cuba stands out among the novelties of the preliminary draft of the Code for this matter, available to the public from this day, experts agreed today.
The professor of Law at the University of Havana Leonardo Pérez assured that this particularity reflects the evolution of social thought in the country.
The proposal for the new Family Code breaks paradigms and requires a mentality of plural sense and inclusion, he acknowledged in a television appearance for the Round Table program.
For his part, the Cuban Minister of Justice, Oscar Manuel Silvera, recalled that the current regulation in the branch dates from 1975.
“Due to the development of society itself, it was no longer coherent, especially due to the diversity of families that exist,” agreed the owner.
In the jurist’s opinion, it is essential to provide the country with a norm that resembles its current context and seeks a mechanism for conflict solutions, not bureaucratized.
After intense work, 22 versions were drawn up until the current draft was reached, which included experts from institutions such as the Supreme Court of Justice, the Prosecutor’s Office, the Federation of Cuban Women, the Ministry of Public Health, the National Center for Sex Education, among others.
In the opinion of the vice president of the Union of Jurists, Yamila González, the proposal also strengthens the protection of women for their empowerment and against violence due to gender issues.
Meanwhile, the protection of children and adolescents and their role in Cuba is also strengthened with the new version.
The document includes more than 480 articles with substantive standards, defining issues such as powers and duties; and procedural, with the establishment of procedures.
Among other novel aspects, the recognition of various types of families but with equal rights before the law as well as the union of the fact and the declaration of marriage as the union between two people stand out.
